The constitution of Association

Chapter 1    General rules

      First article The association is named the Chinese Medical Education Association. English Name: China Medicine Education Association. The abbreviation of English is CMEA.

      Second article The association is formed voluntarily by institutions of higher learning, vocational and technical schools in senior high schools, medical institutions, medical research institutions, pharmaceutical enterprises and other relevant units and personnel engaged in medical education and training. It belongs to a national, professional and non-profit social organization and has the legal personality of a social group.

      Third article The aim of this association is to adhere to the important ideas of Marxism-Leninism, Mao Zedong Thought, Deng Xiaoping Theory and the "Three Representatives", adhere to the Party's basic line, adhere to the scientific concept of development, build a harmonious society, and comprehensively implement the Party's education, drug supervision and management, medical and health work guidelines and national policies and regulations. The association is Focusing on the spirit of the reform of the medical and health system, we should speed up the reform of the medical and education system and discipline construction, and focus on training and cultivating compound, high-skilled, professional and international rules-proficient medical and drug supervision professionals who are open to the outside world. To organize member units to jointly develop pharmaceutical education, improve the quality of medical practitioners, and serve the two civilizations of the pharmaceutical industry and the modernization of medicine. The association observes the constitution, laws, regulations and national policies, and observes socialist morality.

      Fourth article The State-owned Assets Supervision and Administration Commission of the State Council and the Ministry of Civil Affairs, the organ responsible for the registration of associations, are the competent units of the association. The Association receives the guidance and supervision of the higher units.

      Fifth article The residence of this association: Beijing.

      The second chapter    Scope of business

     Sixth article The scope of business of this association

  (One)Participate in the national medical education and training work planning, planning, discipline construction, teaching quality evaluation, participate in the formulation, research and discussion of relevant policies and standards and norms of training institutions in the pharmaceutical industry, and provide reference and constructive suggestions for decision-making of relevant departments.

  (Two)Receive research projects or related tasks of medical education, training, health education and health promotion, which was entrusted by competent business units and other relevant government departments and institutions.

  (Three)To provide advice and services for the educational reform of pharmaceutical colleges and universities, vocational and technical schools at all levels, and all kinds of school-running institutions at all levels, as well as the education and training of pharmaceutical enterprises and institutions in China.

  (Four)Making investigation and study to the situation and problems in medical education and training, and summarize the achievements and experience of promoting the reform of medical education.

  (Five)Participate in teaching activities of medical education, organize training, carry out health education and health promotion activities, organize and compile relevant textbooks, and promote the construction of medical and health information.

  (Six)Under the conditions approved by the relevant government departments, the credit evaluation of pharmaceutical enterprises and non-governmental educational institutions should be carried out to promote the construction of honesty and credit of pharmaceutical enterprises.

  (Seven)It is necessary to carry out theoretical research and academic exchanges on medical education and training, strengthen contacts with other mass organizations and organizations, and participate in activities of relevant academic organizations at home and abroad.

 (Eight)To carry out international academic exchanges and cooperation on medical education and training.

 (Nine)Medical education and training organization published in academic journals and books, commissioned by the government or contractor according to the market and the development of the industry needs to conduct medical education aspects of the exhibition activities.

Third chapter   members

    Seventh article The membership types of this association are: unit members and individual members.

    Eighth article   For the association's members must meet the following conditions:

(One)Uphold the constitution of this association;

(Two)Have the desire to join the association;

(Three)Has a certain influence and appeal in the association's business scope;

(Four)Medical colleges and universities, medical institutions, pharmaceutical enterprises and institutions, and organizations engaged in medical education may apply to become members of the associations.

(Five)Medical educators, experts and scholars, can apply to become the association of individual members.

Ninth article The procedures for membership accession are as follows:

(One)Submit an application for membership;

(Two)Discussed and passed by the Council and the Standing Council.

(Three)A certificate issued by a Council or Council authorized body to a member.

Tenth article Members enjoy the following powers:

(One)The right to vote, the right to vote and the right to vote of the Association;

(Two)Participate in the activities of this association;

(Three)The priority of this association's services;

(Four)It has the right to criticize and advise the work of this association;

(Five)Voluntary participation and freedom of withdrawal.

Eleventh article Members must perform the following obligations

(One)Comply with the articles of association of the implementation of the resolutions of the association;

(Two)Safeguard the legitimate rights and interests of the Association;

(Three)Finish the work assigned by this association;

(Four)Pay the membership fee according to the regulations;

(Five)To reflect the situation and provide relevant information to this association;

(Six)Actively participate in related activities organized by this association.

Twelfth article If members withdraw from the meeting, they should notify the association in writing and return the membership card. If members fail to fulfill their obligations for 2 years, they will be deemed to be automatically returned.

Thirteenth article Members who violate national laws and regulations or seriously violate these Articles of Association shall be removed by vote of the Council or the Standing Council.

The fourth chapter Organization and responsible persons produce and recall

Fourteenth article The supreme authority of the association is a member's Congress. Its functions and powers are as follows:

(One)Formulation and revision of association regulations;

(Two)Election and removal of governing units;

(Three)Review the work report of the Council and the financial report;

(Four)Formulation and revision of the membership fee standard;

(Five)Decides to terminate the contract matters;

(Six)Deciding other important matters.

    Fifteenth article A member's Congress must be attended by representatives of 2/3 or more, the resolution must be passed by more than half of the members of the meeting.

    Sixteenth article The Congress will last 4 years. If it is necessary to postpone the change of office due to special circumstances, it shall be voted by the Council and submitted to the competent business unit for examination, and finally approved by the registration administration organ of the association. The longest extension is no more than one year.

     Seventeenth article The Council is the executive body of the congress. It leads the association to carry out its daily work during the intercessional period of the Congress and is responsible for the congress.

Eighteenth article The functions of the Council are as follows:

(One)The implementation of resolutions of member congresses;

(Two)Election and removal of presidents, vice presidents, secretaries general and executive directors;(Three)Preparations for the convening of the member's Congress;

(Four)Report on work and financial status to member congresses;

(Five)Deciding the absorption and removal of members;

(Six)Deciding on the establishment, cancellation and alteration of offices, branches, representative offices and entities;

(Seven)Decides the appointment of the deputy secretary general and the principal responsible persons of each institution;

(Eight)Deciding on the establishment and selection of honorary posts;

(Nine)Formulating the guidelines and tasks of this association and leading the various organizations of the association to carry out their work;

(Ten)Formulating the internal management system of the association.

(Eleven)Deciding other important matters.

   Nineteenth article The Council must have more than two-thirds of its members present before it can be convened, and its resolutions must be voted on by more than two-thirds of its members before they can come into force.

Twentieth article The council meets at least 1 times a year. Under special circumstances, it can be convened in the form of communication.

   Twenty-first article The association establishes a standing council. The Standing Council is elected by the Council, with no more than 1/3 of the Governing Council. During the intersessional period of the Council, the Standing Council exercises the functions and powers of Items 1, 3, 5, 6, 7, 8, 9 and 10 of Article 18 and is responsible to the Council.

Twenty-second articles The Standing Council shall have more than two-thirds of its standing members present before it can be convened, and its resolutions shall be voted on by more than two-thirds of its standing members before they can come into force.

     Twenty-third article The Executive Council holds 1 meeting at least half a year. If there are special circumstances, it can be convened by means of communication.

Twenty-fourth article The president, vice president and Secretary General of the association must meet the following requirements:

(One)Adhere to the party's line, principles, policies and political qualities;

(Two)With great influence in the business field of the association;

(Three)The highest serving age is not more than 70 years old, and the secretary general is full-time;

(Four)Healthy body, can adhere to the normal work;

(Five)Not penalized by deprivation of political rights;

(Six)With full capacity for civil conduct.

     Twenty-fifth article The president, vice president and Secretary General of the association should go through the formalities if they exceed the maximum age of service.

Twenty-sixth article The president, vice president and Secretary General of this association shall serve for a term of 4 years, and not even more than two term.

     Twenty-seventh article The president is the legal representative of this association.

Under special circumstances, with the authorization of the President and the consent of the Council, the Vice-President may act as the legal representative after submitting the report to the competent business units for examination and approval by the administrative organ for the registration of associations.

The legal representative shall sign relevant documents on behalf of the association.

The legal representative of the legal representative of this society do not serve other groups of people.

     Twenty-eighth article The president of the association exercises the following functions and powers:

(One)Convene and preside over the Council and the Standing Council;

(Two)Check the implementation of resolutions of member congresses, Council and Executive Council.

Twenty-ninth article The Secretary General of the association exercises the following functions:

(One)Leading organizations carry out daily work and organize annual work plans.

(Two)Coordinate the work of branches, representatives and entities;

(Three)To nominate the Under-Secretary-General and the principal heads of various agencies and submit them to the Council or the Standing Council for consideration and adoption;

(Four)Deciding on the appointment of full-time staff in offices, representative offices and entities;

(Five)Dealing with other daily affairs.

The fifth chapter   Asset management and use principles 

   Thirty-first article Sources of funding for the association:

(One)Membership fee;

(Two)The donation;

(Three)The government funded;

(Four)Income from activities and services within the approved business scope;

(Five)The interest;

(Six)Other legitimate income.

     Thirty-second article The association receives membership dues according to the relevant regulations of the state. 

     Thirty-third article The funds of the Association must be used for the scope of business and career development stipulated in the Articles of Association and shall not be allocated among its members.

Thirty-fourth article The association establishes a strict financial management system to ensure the legality, authenticity, accuracy and integrity of accounting information.

     Thirty-fifth article The association is staffed with professional qualifications. Accountants should not be part-time cashiers. Accountants must carry out accounting and carry out accounting supervision. If the accountant transfers his job or leaves office, he must clear the handover procedure with the takeover officer.

     Thirty-sixth article The asset management association must implement the provisions of the state financial management system, accept the supervision of members of Congress and the financial sector. Where the source of assets belongs to state appropriations or social donations or subsidies, they must be subject to the supervision of audit institutions and the relevant information shall be made public in an appropriate manner.

    Thirty-seventh article Before changing its term or changing its legal representative, the association must accept the financial audits of the auditing organizations approved by the registration administration agencies of associations and the competent business units.

    Thirty-eighth article The assets, units and individuals of this association shall not be appropriated, privately divided or misappropriated. 

    Thirty-ninth article The salaries, insurance and welfare benefits of full-time staff of this association shall be implemented in accordance with the relevant provisions of the state.

The sixth chapter   Procedures for amendment of articles of Association 

Fortieth article Amendments to the articles of association of the association shall be submitted to the members' Congress for deliberation after the vote is passed by the Council.

     Forty-first article The amended articles of association shall be submitted to the competent business units for examination within 15 days after the adoption of the member congress, and shall not come into force until they have been approved by the registration authority of the association.

The seventh chapter   Termination procedures and disposal of property after termination 

     Forty-second article The purpose of association to complete or self-dissolution or due to separation, merger or other reasons to cancel, the Council or the Executive Council to terminate the agreement. The termination of the agreement shall be passed by the member's Congress and submitted to the competent business unit for examination and approval.

     Forty-third article Before the termination of the association, a liquidation organization shall be established under the guidance of the competent business units and relevant organs to clear up creditor's rights and liabilities and deal with aftermath matters. During liquidation, activities other than liquidation are not carried out.

     Forty-fourth article The association is terminated after cancellation by the societies registration authority.

Forty-fifth article The remaining property after the termination of this society, under the supervision of the competent business unit and the registration administration organs, in accordance with the relevant provisions of the state, for the development of the related business purposes of the association.

The eighth chapter   Supplementary articles 

     Forty-sixth article The constitution was voted and passed by the 1 member congress of the third session.

     Forty-seventh article The power to interpret this constitution is the Council of this association.
